Walter Inteligencia Natural, SLU ("Walter Inteligencia Natural", "us", "we", or "our"), company with tax ID B88318035, based at Paseo de la Castellana, 95, floor 29, 28046 Madrid (Spain), listed in the Companies Registry of Madrid, volume 38859, page 8, record M-690739, entry 1, and with web address https://www.walterin.es, operates and is the owner of https://www.makequestions.com ("MakeQuestions", "the website"), and is the provider of the services object of these Purchase terms and conditions ("terms").

Object and parties

The Purchase terms and conditions established here are intended to regulate the processes of purchase and contracting by the client of services provided by Walter Inteligencia Natural by means of or through its platform MakeQuestions. It is understood by "client" the individual and/or company or other legal entity that performs the service purchase and contracting process at MakeQuestions. The purchase and contracting process at MakeQuestions is performed between the client and Walter Inteligencia Natural, both parties acknowledging each other the needed legal capacity to perform the process mentioned before.

These terms will remain valid while they are accessible on the website, and they may be modified by us without prior notice, updating the corresponding modification date.

Services

The services object of the present terms are provided by means of MakeQuestions and are property of Walter Inteligencia Natural. The client, through the contracting of the services, acquires a right to use the services mentioned before, during a certain period of time, and in exchange of the payment of an economic amount or price. Two basic types of services are distinguished, one-time payment services and recurring periodic payment services.

The one-time payment services, like for example user level upgrading, imply the payment by the client of a single amount of money at the moment of the purchase, and the client mentioned before being able to use the functionalities of the service from that moment indefinitely, while MakeQuestions or the service itself continues to be operational.

The recurring periodic payment services, like for example MakeQuestions site service, imply the payment by the client of a periodical amount of money or fee, for example monthly, paying the first fee at the moment of the purchase, and the client being able to use the functionalities of the service while the payment of the periodic fees is satisfied, and while MakeQuestions or the service itself continues to be operational. From the moment that the payment of the fees or periodic payments is not made effective, the service will be inactive, being able to reactivate it once the client resumes the payment of the fees mentioned before.

In case the client breaches the general Terms of service of MakeQuestions, accessible on the website, Walter Inteligencia Natural may, unilaterally, immediately and without liability, cancel and/or deactivate the service without being able the client to earn any economic compensation for that and/or for the damage caused.

The service is provided 'as is', with the functionalities and features described on the website, and not assuming Walter Inteligencia Natural any commitment or warranty beyond what is described in those features and functionalities.

Client information

Along the purchase process, the client will have to provide MakeQuestions with certain data that will be used for invoicing purposes. These are, among others, name, address, tax identification number, city, country, e-mail address, and if the client is an individual or a company/organization. Walter Inteligencia Natural commits to use these data only for the set purpose and with strict observance of current legislation regarding this matter. The client commits to the truthfulness and completeness of the provided information, for a proper subsequent invoicing.

Payment

Once the client introduces the information for invoicing purposes and click on the buy button, he/she will be redirected to a payment gateway where he/she will have to introduce the data of his/her debit or credit card. This payment gateway is a secure system provided by a banking entity and therefore is a system outside and external to MakeQuestions. In no event MakeQuestions captures and/or keeps data related to debit or credit cards and other client payment methods.

The payment gateway will perform the needed checkups and authorizations in order to carry out the payment of the purchase. In case the payment could not be authorized, the purchase process would not continue and would be cancelled.

Whether the payment is authorized or not, once the result of the operation is obtained by the payment gateway the client is redirected back to MakeQuestions. In case the payment has been authorized and made, the contracted services would already be active for their use by the client. In case of denial or non-authorization, no payment will have been made and the service will not have been activated, being able the client to make new payments attemps with the same or another payment method.

Order cancellation

It is possible to cancel the service contracting process during the course of it. Once the service contracting process is completely fulfilled and the payment is made, the order can not be cancelled, as the service is deployed and activated automatically, being able the client to use the service from that moment on. Notwithstanding the above, for recurring periodic payment services, the client can cancel the service at any time, without having to fulfill any commitment of permanence.

Return and refund

Because these terms are applied to services that are activated and ready for use immediately after the client performs the purchase process and makes the payment, it is considered that from that moment onwards the client is already using the contracted service, therefore the possibility of service return or refund of the amount paid is not considered.

Security and protection to purchasers

Walter Inteligencia Natural does its best effort in providing services with the maximum possible security for its clients and users, among which are the services object of these terms and the purchase and contracting service itself. MakeQuestions' technological infrastructure is hosted on a secure data center and the servers have SSL certificates that allow secure data encryption to assure the confidentiality of information. The payment gateway is provided by a top-tier financial entity that meets the most demanding standards of the industry. However, we need to remember that no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we strive to use commercially acceptable means to protect the personal information of clients and users, we cannot guarantee its absolute security.

For any need of additional informacion, suggestion, support, doubt solving or complaint related to the purchase and contracting of MakeQuestions services, the client can contact Walter Inteligencia Natural at Paseo de la Castellana, 95, floor 29, 28046 Madrid (Spain), at upgradeuser@makequestions.com regarding user level upgrade services, or at business@makequestions.com regarding MakeQuestions site services.

Privacy and data protection

All the information provided by the client during the service contracting process, except the credit/debit card data mentioned before, will be stored by us and included into a file whose ownership is of Walter Inteligencia Natural, operator of the website, being Walter Inteligencia Natural responsible for the file with the personal data of the clients who have made MakeQuestions service purchases and contracting.

These data will be used by Walter Inteligencia Natural only for activities related to billing, to the clients for the contracted services. Only in unusual and justified cases, due to problems with the services, terms of service infringement or because any other need of indispensable communication from Walter Inteligencia Natural to the client, we will be able to contact him/her by the means that the provided data allow.

The information will not be shared with third parties. In case there is any imperative that forces to share client information with any other company or entity, Walter Inteligencia Natural will report it to the client and will request authorization to do it.

The client will be able to exercise access, amendment, deletion or objection rights regarding the provided personal data, communicating it in writing and with a copy of a trustworthy identity accreditation document, to the mailing address Paseo de la Castellana, 95, floor 29, 28046 Madrid (Spain).

The client commits to provide, along the purchase process, truthful, certain and complete information, with the aim of avoiding unwanted impacts on the corresponding billing. The client also commits to report changes and modifications in the information initially supplied, particularly in case of recurring periodic payment services.

Applicable legislation and jurisdiction

Both parties expressly agree that these terms will be ruled and interpreted in accordance with the laws of Spain, without regard to its conflict of law provisions. Besides, the parties, with express waiver to their own charter, if this was other, agree to be subjected to the jurisdiction and scope of the Courts of Law and Tribunals of Madrid, in order to solve any discord that may arise from the application, compliance and execution of the terms and conditions of this contract.

The Service is provided 'As Is' without any express or implied warranty of any kind, including but not limited to any warranties of merchantability, noninfringement, or fitness of a particular purpose. Walter Inteligencia Natural, SLU does not warrant or assume responsibility for the accuracy or completeness of any information, text, graphics, links or other items contained within the Service. Walter Inteligencia Natural, SLU makes no warranties respecting any harm that may be caused by the transmission of a computer virus, worm, time bomb, logic bomb, or other such computer program. Walter Inteligencia Natural, SLU further expressly disclaims any warranty or representation to Authorized Users or to any third party.

Limitation Of Liability
